Terms of Service

1. Eligibility

Lyna is intended for users aged 18 and older. By using the App, you represent and warrant that you are at least 18 years of age. If you are under 18, you are not permitted to use the App. We reserve the right to terminate accounts of users who are found to be under the age of 18.

2. Account and Registration

• You may create an account using the guest login feature or other registration methods provided by the App.
• You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
• You agree to provide accurate and complete information when creating your account and to update your information as necessary.
• We reserve the right to suspend or terminate your account at any time for violation of these Terms.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a single Apple-branded device that you own or control, solely for your personal, non-commercial purposes. This license does not allow you to:

• Distribute, sublicense, or make the App available over a network where it could be used by multiple devices at the same time.
• Copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App.
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App.
• Use the App for any commercial purpose or for the benefit of any third party.
• Use the App in any manner that could damage, disable, overburden, or impair the App.

4. User-Generated Content (UGC)

4.1 Your Content

Lyna allows you to create, post, and share content including but not limited to community stories, comments, photos, camping plans, and profile information (collectively, "User Content"). You retain ownership of your User Content, but by posting it on Lyna, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content within the App for the purpose of operating and providing the Lyna service.

4.2 Content Responsibility

You are solely responsible for all User Content you create, upload, post, or share through the App. You represent and warrant that:

• You own or have the necessary rights and permissions to post your User Content.
• Your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
• Your User Content complies with these Terms and all applicable laws and regulations.

4.3 Prohibited Content – Zero Tolerance Policy

Lyna maintains a strict zero-tolerance policy for objectionable content and abusive users. The following content is strictly prohibited on our platform. Violation of these rules may result in immediate content removal and permanent account termination without prior warning:

Sexually Explicit and Pornographic Content: Any content depicting, promoting, or soliciting sexual acts, nudity, pornography, or sexually suggestive material is strictly forbidden. This includes explicit images, sexual text descriptions, links to adult websites, sexually suggestive comments, content that sexualizes individuals, and any form of sexual solicitation. There are no exceptions to this rule.

Disturbing, Graphic, and Violent Content: Content designed to shock, disgust, frighten, or cause psychological discomfort is prohibited. This includes graphic depictions of violence, gore, blood, mutilation, torture, animal cruelty, self-harm, suicide, death, and any imagery or descriptions intended to disturb, traumatize, or upset other users.

Gambling and Betting Content: Any content that promotes, advertises, facilitates, or provides instructions for gambling, betting, lotteries, casinos, sports wagering, poker, slot machines, or any form of games of chance involving money, cryptocurrency, or prizes is not permitted.

Drug and Substance Abuse Content: Content that promotes, glorifies, sells, advertises, or provides instructions for the use, manufacture, cultivation, distribution, or acquisition of illegal drugs, controlled substances, recreational drugs, drug paraphernalia, or the misuse of legal substances including prescription medications, alcohol abuse, and tobacco products targeting minors is strictly prohibited.

Political Content and Propaganda: Content promoting political campaigns, political parties, political candidates, political propaganda, partisan political messaging, political fundraising, voter manipulation, or content designed to influence political opinions, elections, or referendums is not allowed. Lyna is dedicated to outdoor and camping experiences, and political discourse falls outside the scope of our community.

Discriminatory Content and Hate Speech: Any content that promotes, incites, or condones hatred, discrimination, harassment, intimidation, or violence against individuals or groups based on race, ethnicity, color, national origin, immigration status, religion, faith, gender, sex, gender identity, gender expression, sexual orientation, disability, medical condition, genetic information, age, veteran status, caste, socioeconomic status, or any other protected characteristic is strictly forbidden. This includes racial slurs, ethnic stereotypes, dehumanizing language, symbols associated with hate groups, Holocaust denial, and any form of supremacist ideology.

Harassment, Bullying, and Threats: Content that targets, threatens, intimidates, stalks, or harasses specific individuals is prohibited. This includes doxxing (publishing private personal information), cyberstalking, coordinated harassment campaigns, death threats, threats of physical violence, blackmail, extortion, and persistent unwanted contact.

Terrorism and Violent Extremism: Content that promotes, supports, glorifies, recruits for, or provides material support to terrorist organizations, violent extremist groups, or acts of terrorism or mass violence is strictly prohibited.

Fraud, Scams, and Deception: Content designed to deceive, defraud, mislead, or scam other users is prohibited. This includes phishing attempts, pyramid schemes, Ponzi schemes, fake giveaways, impersonation, catfishing, and misleading claims about products or services.

Intellectual Property Violations: Content that infringes upon copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party is not permitted.

Illegal Activities: Content that promotes, facilitates, or provides instructions for any illegal activity, including but not limited to theft, vandalism, trespassing, weapons trafficking, human trafficking, and exploitation of minors.

4.4 Content Moderation and Enforcement Mechanisms

To maintain a safe, respectful, and welcoming community, Lyna provides the following moderation tools and enforcement mechanisms:

• Report Function: Every user has the ability to report content or users that violate our community guidelines. We take all reports seriously and review them promptly. Substantiated reports result in content removal and may lead to account warnings, suspensions, or permanent termination.
• Block Function: Users can block other users at any time. Blocking a user prevents them from viewing your content and interacting with you. You can manage your block list from the Settings section of the App. Blocking is immediate and does not require approval.
• Content Removal: We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms, our community guidelines, or applicable law, without prior notice to the content creator.
• Account Suspension and Termination: Users who violate our content policies may face temporary suspension or permanent termination of their accounts. Severe violations (such as posting sexually explicit content, hate speech, or content promoting violence) may result in immediate permanent termination without prior warning. Terminated accounts will lose access to all data and any purchased virtual currency without refund.

4.5 User Acknowledgment

By using Lyna, you acknowledge and agree that:

• You will not post, upload, or share any content that falls within the prohibited categories listed above.
• We have the right to review, moderate, and remove any content at our sole discretion.
• We have the right to terminate your account for violations of these content policies.
• You will use the report and block features to help maintain community safety.
• We do not tolerate objectionable content or abusive behavior in any form.

5. In-App Purchases and Virtual Currency

5.1 Virtual Coins

Lyna offers virtual coins ("Coins") that can be purchased through Apple's In-App Purchase system. Coins can be used within the App to unlock campsite spots and access certain features.

5.2 Purchase Terms

• All in-app purchases are processed by Apple and are subject to Apple's App Store terms and conditions.
• Prices for Coin packages are displayed in the App and may vary by region. All prices include applicable taxes.
• Purchases are charged to your Apple ID account upon confirmation.
• You must be the authorized account holder of the Apple ID used to make purchases.

5.3 Virtual Currency Terms

• Coins are virtual items with no real-world monetary value.
• Coins cannot be exchanged for cash, transferred to other users, or redeemed outside of the Lyna App.
• Coins are non-refundable except as required by applicable law or Apple's refund policy.
• Your Coin balance is stored locally on your device. Deleting the App, using the "Delete Account" feature, or losing your device will result in permanent loss of your Coin balance. We are not responsible for lost Coins due to device issues, app deletion, or account deletion.
• We reserve the right to modify the pricing, availability, and functionality of Coins at any time.
• Coins purchased on one device are not transferable to other devices unless the same account data is present.

5.4 Refunds

Refund requests for in-app purchases should be directed to Apple in accordance with Apple's refund policy. We do not process refunds directly. Visit https://reportaproblem.apple.com to request a refund from Apple.

6. Intellectual Property

The App, including its design, graphics, text, images, logos, icons, software, and all other content (excluding User Content), is the property of Lyna and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Device Permissions

The App may request access to certain features of your device:

• Camera: Used to take photos for community stories and profile avatars.
• Photo Library: Used to select photos for community stories and profile avatars.

These permissions are optional and requested only when you initiate a relevant action. You can manage these permissions in your device's Settings at any time.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER CONTENT POSTED BY USERS. USER CONTENT REPRESENTS THE VIEWS AND OPINIONS OF THE INDIVIDUAL USERS AND DOES NOT REFLECT OUR VIEWS OR OPINIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LYNA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App.
• Any conduct or content of any third party on the App, including User Content.
• Any User Content obtained from the App.
• Unauthorized access, use, or alteration of your data.
• Loss of virtual currency (Coins) due to device issues, app deletion, or account termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lyna and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your User Content.
• Your violation of any rights of any third party.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your license to use the App will immediately cease.
• You must delete the App from your device.
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
• Any unused Coins in your account will be forfeited without refund.

You may terminate your account at any time by using the "Delete Account" feature in the App's Settings or by uninstalling the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Lyna operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction.

15. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from the Apple App Store:

• These Terms are between you and Lyna only, not with Apple. Lyna is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lyna regarding the use of the App and supersede all prior agreements and understandings.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Effective Date" at the top of these Terms. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
